Employment – help with unpaid salary
Amardeep came to Centre after her employers did not pay her last month’s salary or the commission which was due to her.
First, we compiled a basic chronology and case summary. Next we assisted with a Letter before Action to send to the other side. Then we advised on using Money Claims On Line (the HM Court Service system for money claims) and assisted in writing particulars of claim for her. Amardeep then issued the claim herself at home, online. In response, a Defence was filed and the matter became defended proceedings.
Amardeep attended the Centre regularly for ongoing advice and assistance in completing various forms, paperwork and witness statements along the way in the court proceedings. It was important that we made her witness statement very thorough, as English is not her first language and so any questions asked by the judge on the day of trial would lead to difficulty (SWLAC does not attend hearings with clients).
On the day of the trial, the defendant attended with a solicitor, Amardeep attended unrepresented, and she successfully obtained Judgment for a sum of over £4,000.00 plus costs.
